Welcome to Ongo Mobile ("Company", "we", "our", "us"). These Terms of Service ("Terms") govern your use of our customer relationship management software and services (collectively, the "Service").
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.
When you create an account with us, you must provide accurate, complete, and current information at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
Our Free Plan is provided at no cost and includes limited features as specified on our pricing page. Free Plan limitations include:
The Pro Plan is a paid subscription that provides access to additional features including unlimited customers, technicians, routes, and advanced export capabilities. Pricing for the Pro Plan is displayed on our pricing page and is subject to change with notice.
Pro Plan subscriptions are billed in advance on a monthly or annual basis depending on the plan you select. Payment is due at the beginning of each billing cycle and is non-refundable except as required by law or as explicitly stated in these Terms.
You may cancel your Pro subscription at any time. Upon cancellation, your account will be downgraded to the Free Plan at the end of your current billing cycle. You will retain access to Pro features until the end of the paid period.

You retain all rights to the customer data, notes, and other information you input into the Service ("Your Data"). We claim no intellectual property rights over the material you provide to the Service.
We implement commercially reasonable technical and organizational measures to protect Your Data against unauthorized access, loss, or alteration. However, no method of transmission over the Internet or electronic storage is 100% secure.
Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices regarding the collection and use of your personal information.
While we perform regular backups of the Service, you are responsible for maintaining your own backups of Your Data. We recommend regularly exporting your customer data.
The Service and its original content, features, and functionality are and will remain the exclusive property of Ongo Mobile and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.
Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Ongo Mobile.
Our Service may contain links to third-party websites or services (such as Setmore, QuickBooks, or calendar services) that are not owned or controlled by Ongo Mobile.
Ongo Mobile has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Ongo Mobile shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of any such content, goods, or services available on or through any such websites or services.
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. ONGO MOBILE AND ITS SUPPLIERS AND LICENSORS HEREBY DISCLAIM ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
ONGO MOBILE MAKES NO WARRANTY THAT THE SERVICE WILL BE ERROR-FREE OR THAT ACCESS THERETO WILL BE CONTINUOUS OR UNINTERRUPTED.
IN NO EVENT SHALL ONGO MOBILE, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
